GenOn Potomac Settles Legacy Environmental Claims at Potomac River Generating Site; Clearing Way for Redevelopment

 

Houston, Texas, May 29, 2020).  Effective May 26, 2020, GenOn Potomac River, LLC (“GenOn Potomac”), an indirect subsidiary of GenOn Holdings, Inc., reached a settlement agreement with the District of Columbia (the “District”).  The settlement resolves allegations by the District, by and through the Attorney General for the District that, between January 2010 and September 2013, GenOn Potomac’s predecessor, NRG Potomac River, LLC, discharged pollutants into the Potomac River in violation of the District’s Water Pollution Control Act, along with related claims.  GenOn Potomac denied the allegations. 

 Under the settlement agreement, GenOn Potomac will pay a total of $2.5 million to settle all claims alleged by the Attorney General.  The Northeast Environmental Enforcement Project and the Potomac Drinking Water Source Protection Partnership will each receive $50,000 to be used to improve and remediate the water quality of the Potomac River.  The balance of the settlement  - $2.4 million – will be paid directly to the Attorney General. 

On December 14, 2018, GenOn Holdings, Inc. acquired the assets and liabilities of GenOn Energy, Inc., which included NRG Potomac River, LLC, when GenOn Energy, Inc.  emerged from Chapter 11 bankruptcy protection.  NRG Potomac River, LLC was renamed GenOn Potomac River, LLC in the first quarter of 2019.

 GenOn Potomac is pleased to have resolved this legacy matter with the District.  The settlement is an important step on the way to repurposing and redevelopment of the Potomac River Generating Station site.
